1.1 These Terms and Conditions govern the ACHW Gold Card Program and the use of the Gold Card and set out important information for Gold Card Holders.
1.2 Each Gold Card Holder is responsible for complying with, and ensuring that any guests comply with, these Terms and Conditions.
1.3 These Terms and Conditions are effective from date of publication and may be amended from time to time.
1.4 The ACHW Gold Card Program is delivered by the Australian Institute of Management Education and Training Pty Limited (AIM).
2.1 In these Terms and Conditions, unless the context otherwise requires:
‘ACHW’ (also referred to as ‘us’) means Australasian College of Health & Wellness Pty Ltd; ABN 16 139 036 721,
‘AIM Short Courses’ means AIM unaccredited short courses offered by AIM as set out in the eligible AIM Short Course list from time to time;
‘Gold Card Holder’ (also referred to as ‘you’ or ‘your’) means a person whom is a participant in the ACHW Gold Card Program and holds a Gold Card at the relevant time;
3.1 The ACHW Gold Card Program is available to all ACHW students whom fulfil the following criteria:
(a) an ACHW undergraduate student whom is currently studying and actively progressing an Associate Degree in Applied Health Science (Dermal Therapy) unit or units;
(b) an ACHW student whom is currently studying and actively progressing a Bachelor of Applied Health Science (Clinical Aesthetics) unit or units;
3.2 For new students the ACHW Gold Card is valid for a term of five years commencing from initial Associate Degree in Applied Health Science (Dermal Therapy) or Bachelor of Applied Health Science (Clinical Aesthetics) unit enrolment course start date.
3.3 The ACHW Gold Card Program is not available to ACHW students whom are part of a non-public, closed cohort Applied Health Science degree program; enrolled through ADSI; or any students’ residing outside of Australia.
4.1 Your Gold Card will be sent to you electronically via email at the time of unit enrolment and activated either;
(a) when payment for the relevant Associate Degree in Applied Health Science (Dermal Therapy) or Bachelor of Applied Health Science (Clinical Aesthetics) unit is received; or
(b) at the census date of the relevant ACHW Associate Degree in Applied Health Science (Dermal Therapy) or Bachelor of Applied Health Science (Clinical Aesthetics) unit.
4.2 It may take up to ten (10) to fourteen (14) business days for your new Gold Card to be issued and timeframes may be increased over a public holiday period.
4.3 You acknowledge and agree that the Gold Card is not redeemable for cash, not transferable and cannot be used in conjunction with any other offer or vouchers.
5.1 Gold Card Holders will need to enrol in available AIM Short Courses via the personalised link found in the email containing your Gold Card.
5.2 Gold Card Holders will have designated spots available in each AIM Short Course and is subject to course availability.
5.3 Courses delivered in partnership with other providers may not be included in the Gold Card Program.
6.1 It is a condition of the ACHW Gold Card Program that you consent and authorise AIM to collect and use the information on your application form and other information you provide for the purpose of:
(a) AIM or any of its related bodies improving AIM customer service, including by means of research, marketing, product development and planning;
(b) AIM or any of its related bodies marketing its products or services or the products or services of third parties; and
(c) any third party providing services to AIM, any of its related bodies or Gold Card Holders in connection with the administration of the ACHW Gold Card Program.
This information may be transferred to or from Australia for these purposes. If all or any part of requested information is not provided by the Gold Card Holders, the relevant services may be affected.
6.2 AIM will not otherwise disclose your personal information without your consent unless disclosure is either necessary to prevent a threat to life or health, authorised or required by law, reasonably necessary to enforce the law or necessary to investigate a suspected unlawful activity.
6.3 AIM will provide you with access to and the ability to correct your personal information held by AIM on request by you. Further information is contained in our Privacy of Student Information and Records.
7.1 ACHW reserves the right to vary the ACHW Gold Card Program to which the Gold Card provides access, and these Terms and Conditions including but not limited to amending which AIM Short Courses are deemed eligible short courses to be included in on the eligible AIM Short Course list.
7.2 ACHW will use reasonable endeavours to advise Gold Card Holders of any material changes to the ACHW Gold Card Program including but limited to by publishing the changes in the ACHW Learning Management System (LMS).
7.3 ACHW will give notice of any material changes to these Terms and Conditions that will apply to a Gold Card Holder’s current access period by publishing the changes on the ACHW Learning Management System (LMS) or via its website at achw.edu.au
8.1 Some of the goods or services which are offered or provided to Gold Card Holders in addition to the benefits offered as part of the ACHW Gold Card Program provided by ACHW may be supplied by third party suppliers. The provision of those goods or services will be subject, in each case, to the terms and conditions of the suppliers and any claims relating to the supply of those goods or services should be made to the supplier.
8.2 ACHW will not be liable for refusal by any third party to accept or honour the Gold Card nor will ACHW be liable for any loss or damage suffered in relation to the supply of goods or services by third parties.
8.3 Nothing in these Terms and Conditions operates to limit or exclude liability that cannot by law be limited or excluded. ACHW acknowledges that the Gold Card Holder may be a consumer for the purposes of applicable State or Federal law in Australia, with the consequence that certain guarantees may be conferred on the Gold Card Holder and certain rights and remedies conferred on the Gold Card Holder, which cannot be excluded, restricted or modified. To the maximum extent permitted by law, ACHW’s liability to the Gold Card Holder in respect of a breach of a guarantee or a warranty under these Terms and Conditions is limited to the resupply of the relevant benefit or benefits of the ACHW Gold Card Program.
9.1 ACHW reserves the right to terminate or cease to operate the ACHW Gold Card Program at any time.
9.2 ACHW reserves the right in its absolute discretion to terminate the use of any Gold Card at any time by giving such notice to the Gold Card Holder as soon as is reasonably practicable.
Gold card termination includes;
9.3 ACHW reserves the right to terminate the Gold Card if the holder withdraws from their Associate Degree in Applied Health Science (Dermal Therapy) or Bachelor of Applied Health Science (Clinical Aesthetics) course or unit, is not actively enrolled in a current unit, or fails to make payment in the required timeframes.
